Agreement to Terms

By accessing or using Grail Seeker ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

1. Service Description

Grail Seeker is a subscription-based comic book discovery platform that:

• Monitors eBay and other marketplaces for comics matching your specifications
• Sends SMS notifications when matching comics are found
• Provides alert history and search management tools
• Facilitates discovery of rare and collectible comic books

The Service does NOT:

• Purchase comics on your behalf
• Guarantee availability of listed comics
• Provide price guarantees or investment advice
• Sell comics directly

2. Eligibility

Age Requirement

You must be at least 18 years old to use this Service.

Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update your information as needed.

Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• Notify us immediately at [email protected] of any unauthorized access

3. User Accounts

Account Creation

To use our Service, you must:

• Provide a valid email address
• Provide a valid phone number for SMS notifications
• Create a secure password
• Accept these Terms and our Privacy Policy

Account Termination

You may terminate your account at any time through account settings. Upon termination:

• Your subscription will be cancelled
• All personal data will be deleted within 30 days
• You will lose access to alert history and saved searches

We may terminate or suspend your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse or misuse the Service
• Fail to pay subscription fees

4. Subscription and Billing

Pricing

Grail Seeker is a subscription service priced at $13/month.

Payment Terms

• Subscriptions are billed monthly in advance
• Payment processed via Stripe (our payment processor)
• Prices subject to change with 30 days notice
• No refunds for partial months

Free Trial (If Applicable)

• We may offer free trial periods for new users
• Credit card required for trial activation
• Cancel before trial ends to avoid charges
• Trial terms will be clearly disclosed at signup

Cancellation

• Cancel subscription anytime through account settings
• Cancellation effective at end of current billing period
• No prorated refunds for early cancellation

5. Acceptable Use

You MAY:

• ✅ Create searches for comics you intend to purchase
• ✅ Share listing links with friends or fellow collectors
• ✅ Provide feedback and suggestions for improvement

You MAY NOT:

• ❌ Use the Service for commercial resale or arbitrage at scale
• ❌ Abuse or overload our systems with excessive searches
• ❌ Share your account credentials with others
• ❌ Reverse engineer, decompile, or disassemble the Service
• ❌ Use automated tools (bots, scripts) to access the Service
• ❌ Collect or harvest data from the Service for external use
• ❌ Violate any applicable laws or regulations
• ❌ Infringe on intellectual property rights
• ❌ Harass, threaten, or abuse our staff or other users

6. Service Availability

No Uptime Guarantee

• We strive for high availability but do not guarantee uninterrupted service
• Scheduled maintenance may cause temporary outages
• We will notify users of planned maintenance when possible

Service Modifications

We reserve the right to:

• Modify or discontinue features with reasonable notice
• Add or remove supported marketplaces
• Change monitoring frequency or notification delivery
• Update the Service to improve performance or security

No Liability for Missed Opportunities

We are NOT liable for:

• Missed notifications due to technical issues
• Comics sold before you receive alerts
• Inaccurate listing data from third-party sources
• Network or SMS delivery failures
• Marketplace API changes or outages

7. Intellectual Property

Our Rights

All content, features, and functionality of the Service are owned by Grail Seeker IO LLC and protected by copyright, trademark, and other intellectual property laws.

You may NOT:

• Copy, modify, or distribute our software
• Use our trademarks or branding without permission
• Create derivative works based on our Service

Your Data

You retain all rights to your account data. By using the Service, you grant us a license to use this data solely to provide the Service.

8. Third-Party Services

eBay and Other Marketplaces

• We use eBay's Browse API and other marketplace APIs to search for comics
• Purchases occur on third-party platforms (eBay, Heritage, etc.)
• We are NOT responsible for marketplace policies, fees, or disputes
• eBay Partner Network affiliate links may be used (we may earn commissions)

SMS Provider (Twilio)

• SMS notifications delivered via Twilio
• Message and data rates may apply
• Carrier restrictions may affect delivery
• Opt-out available anytime in account settings

Third-party terms and privacy policies apply to their respective services.

9. Disclaimers and Limitations

NO WARRANTIES

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or availability
• Warranties of non-infringement

NO INVESTMENT ADVICE

• We do NOT provide financial, investment, or collectibles advice
• Comic collecting involves financial risk
• Past prices do not guarantee future values
• Consult financial professionals before making significant purchases

10. Indemnification

You agree to indemnify and hold harmless Grail Seeker IO LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws

11. Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

Informal Resolution

Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or collective proceeding.

Severability

No Waiver

Failure to enforce any provision does not waive our right to enforce it later.

Assignment

You may not transfer your rights under these Terms. We may assign our rights to a successor or affiliate.
